There is a scenario of fear embedded in the public memory that has persisted since old Turkish movies: enforcement officers coming to the house load everything from the sofa under you to the refrigerator in the kitchen onto a truck, leaving your house completely empty. This fear that "they will take everything away" creates a very serious psychological pressure on debtor families. However, Turkish enforcement law, especially with the radical legislative reforms made in recent years, has brought the principle of a "life worthy of human dignity" to the fore and imposed very strict boundaries on home foreclosure. The era of the creditor dismantling and taking away any item they want from the house is now over. So, what items can be foreclosed in a home according to current legislation, and which ones are considered luxury? In this article, we put the legal boundaries of home foreclosure under the spotlight with all the details.

The 3rd paragraph of Article 82 of the Enforcement and Bankruptcy Law constitutes the constitution of home foreclosure. According to this provision, "household goods necessary" for the debtor and their family living under the same roof cannot be attached. The purpose of the legislator here is to ensure that the debtor is not deprived of minimum humane living conditions even if they collapse economically. When I analyze the logic of modern enforcement law as a law student, we see that this regulation establishes a delicate balance between protecting the right of the creditor and observing the basic right to life of the debtor. Accordingly, it is completely forbidden by law to attach items essential for the continuation of life in a home, such as a refrigerator, washing machine, oven, stove, bed, and basic seating group.

The "Luxury Goods" Criterion and How the Double Item Rule Works

In order for household goods to be taken under custody (i.e., taken away from the home), that item must either be a "luxury item that is not necessary" or there must be "more than one" item performing the same function in the house. According to the applications of the Court of Cassation, the rules are quite clear: The Double Item Situation: For example, if there are two televisions or two washing machines in the house, one will be deemed sufficient for the debtor to sustain their life, so the second (duplicate) item can be foreclosed and taken from the house. The Luxury Goods Situation: Items that are not indispensable for the life of the debtor and have a very high material value, such as antique items, luxury works of art, precious carpets, or home theater systems, do not fall within the scope of necessary household goods and can be foreclosed. However, a television or computer of normal standards is accepted as a part of the need for education and receiving information today (provided that it is the only one in the house) and cannot be attached.

What Should Be Done in an Unlawful Foreclosure Transaction?

If the enforcement officer and the creditor's counsel coming to your house attempt to attach and take under custody your only refrigerator or necessary sofa set contrary to this explicit provision of the law, there are legal mechanisms through which you can seek your rights. During the foreclosure process, you must make sure to annotate the foreclosure record stating that the item is unique and necessary for life. Afterwards, you must file a complaint lawsuit with the request for the "Removal of Foreclosure" by applying to the Enforcement Court within 7 days from the date the transaction was made. The court will examine the nature of the item through a discovery to be made at the house and will cancel the foreclosure if there is a situation contrary to the law. In conclusion, being a debtor does not take away anyone's fundamental human rights; knowing the legal boundaries will protect you from unjust pressures.
